Certificate of Design Compliance (BA3)

A certificate of design compliance (CDC) is required in order to obtain a building permit from the permit author to construct a building or incidental structure.

Certificate of Building Compliance (BA18)

A certificate of Building Compliance (CBC) is required in order to obtain an occupancy permit (other than an occupancy permit required for a completed building or an incomplete building for which a CCC would be required), or a building approval certificate (with or without building authorisation) or a building approval certificate strata.

As a registered Building Surveyor company, we can confirm:

  • That the building or incidental structure substantially complies with the applicable building standards;
  • That the building or incidental structure in its current state in the way proposed in the application would not adversely affect the safety and health of its occupants or other users;
  • That the building or incidental structure complies with each authority under a written law that is prescribed in r. 36 of the Building Regulations; and
  • That when relevant, the building or incidental structure substantially complies with the building permit, building licence or other approval that was granted in respect of the construction of the building or incidental structure.

Certificate of Construction Compliance (BA17)

A certificate of construction compliance (CCC) is required in order to obtain an occupancy permit from the permit authority. These are needed to occupy a newly completed Class 2 to Class 9 building or a newly completed part of the building e.g. addition to a building.

As a registered Building Surveyor company, we can confirm the following points.

Completed buildings:

  • The building has been completed in accordance with the specified plans and specifications outlined in the applicable Certificate of Design Compliance (CDC) for each applicable building permit;
  • The building is compliant with the applicable building permit including each condition that applies to the permit; and
  • The building in its current state is otherwise suitable to be used in the way proposed in the application.

Incomplete buildings:

  • That the building is incomplete;
  • That occupancy of the building in its current state in the way proposed in the application does not adversely affect the safety and health of its occupants; and
  • That the building in its current state is otherwise suitable to be used in the way proposed in the application.

All applicants for compliances certificates must be accompanied by the following:

  1. A copy of any planning permit relating to the proposed building work to which the work application applies;
  2. Drawings showing the plan at each floor level, elevations, sections, dimensions, and the sizes and locations of the structural members to a scale of not less then 1:100, together with any other details that are necessary to show compliance to a scale of not less than 1:20, or to other approved scale;
  3. Specifications describing materials and methods to be used/used in the construction or alteration;
  4. Allotment plans to a scale of not less than 1:500 or other approved scales;
  5. A statement of the use or proposed use of all buildings shown on allotments plans;
  6. A copy of any computations or reports necessary to demonstrate that the building and building work will, if constructed/is constructed by the computations and reports, comply with the regulatory requirements;
  7. If the application is for a building permit to alter an existing building, copies of drawings and allotment plans that differentiate between the existing building and the proposed building work for which the permit or approval is sought.

Additional information may be required to accompany an application for permit or approval such as:

  1. Documentary evidence to support the use of a material, form of construction or design in a form referred to in clause A2.2 of the BCA Volume One or clause 1.2.2 of the BCA Volume Two;
  2. A list of any essential safety measures to be provided in the building or place of a public entertainment to which the building permit will relate;
  3. A survey plan of existing site conditions prepared by a licensed land surveyor; and
  4. Certificate from a competent person to confirm the existing work or form of construction complies with relevant regulatory retirements.
